If a material pricing error affects a completed transaction, HomeCrowd may:
- honour the displayed price;
- request payment of the correct price with your agreement;
- cancel the affected order and provide an appropriate refund.
We will not knowingly use deceptive pricing or hidden mandatory charges.
12. Orders
An order is an offer to purchase the selected product.
An order is not finally accepted until:
- payment is confirmed;
- the product remains available;
- fraud and security checks are satisfied;
- HomeCrowd issues confirmation or fulfills the product.
We may decline or cancel an order where:
- payment is not completed;
- payment cannot be verified;

- there is an obvious pricing error;
- fraud is suspected;
- legal or regulatory restrictions apply;
- you violate these Terms;
- the relevant event or product is cancelled before acceptance.
If payment has been received for an order we cannot fulfill, we will provide an appropriate refund or other remedy required by law.

Payments may be processed by third-party payment providers.
Available methods may include:
- payment cards;
- bank transfer;
- USSD;
- mobile money;
- wallet services;
- other supported methods.
You authorize HomeCrowd and its payment providers to process the amount shown during checkout.
You represent that:
- you are authorized to use the selected payment method;
- the payment information is accurate;
- the transaction is lawful;
- you will not initiate a dishonest chargeback or reversal.
A payment shown as pending is not complete until confirmed by the authoritative payment provider and HomeCrowd’s systems.
A browser message, screenshot, debit alert, or payment redirect may not by itself prove that HomeCrowd received final payment.
If you are debited but do not receive confirmation:
- do not repeatedly pay without checking your order status;
- review My Access or order history;
- contact HomeCrowd support;
- provide the relevant payment reference.
HomeCrowd may conduct payment reconciliation before issuing a ticket, entitlement, refund, or other remedy.

- foreign exchange rates and cross-border fees are controlled by your financial provider;
- HomeCrowd is not responsible for independently imposed bank or currency-conversion charges.
15. Physical Event Tickets
A physical event ticket provides admission to the specified event, subject to:
- these Terms;
- event-specific conditions;
- venue rules;
- ticket category;
- entry time;
- age restrictions;
- security requirements;
- capacity restrictions;
- applicable law.
A ticket does not guarantee:
- a particular fight-card order;
- that every announced fighter will participate;
- an exact bout start time;
- uninterrupted visibility from every location;
- access to restricted areas;
- backstage access;
- interaction with fighters;
- inclusion in event activities not stated in the ticket.
You are responsible for checking:
- event date;
- event time;
- venue;
- ticket category;
- age conditions;
- entry instructions;
- prohibited items;
- other event requirements.
16. Ticket Delivery
Tickets may be delivered through:
- your HomeCrowd account;
- email;
- SMS;
- mobile application;
- another approved method.
Your HomeCrowd account or My Access area is the authoritative location for tickets where available.
You are responsible for providing accurate delivery information.
A failure to receive an email or SMS does not automatically mean the ticket was not issued. You should check your account or contact support.
You must not publish or share the complete QR code, barcode, ticket number, or access credential.
17. Ticket Validity and Entry
Each ticket may be used only according to its conditions.
A ticket may be rejected if it is:
- counterfeit;
- altered;
- duplicated;
- cancelled;
- refunded;
- already used;
- for another event;
- for another date;
- outside its validity period;
- obtained through fraud;
- resold or transferred contrary to applicable conditions.
HomeCrowd or event staff may request:
- the ticket;
- order confirmation;
- the purchaser’s name;
- reasonable identity verification;
- the payment reference;
- evidence of an authorized transfer.
Entry remains subject to venue capacity, safety, security, and applicable law.
A successful purchase does not permit you to:
- bypass security;
- enter restricted areas;
- bring prohibited items;
- engage in unlawful conduct;
- interfere with the event;
- violate venue rules.
18. Ticket Transfers and Resale
Ticket transfer or resale is permitted only where expressly supported by HomeCrowd or authorized by the event organizer.
Unless approved, you must not:
- resell tickets commercially;
- resell tickets above permitted value;
- use tickets for unauthorized promotions;
- bundle tickets with misleading products;
- reproduce or duplicate tickets;
- transfer tickets obtained through fraud.
HomeCrowd may cancel tickets offered or transferred in violation of these Terms, subject to applicable consumer law.
If ticket transfer is supported:
- the transfer must use the approved process;
- the original holder may lose access after transfer;
- the recipient may need a HomeCrowd account;
- additional verification may apply.
19. Venue Conduct and Safety
You must follow:
- venue rules;
- lawful staff instructions;
- safety procedures;
- age restrictions;
- security screening;
- restricted-area rules;
- applicable law.
You must not:
- carry prohibited weapons or dangerous items;
- engage in violence or threats;
- harass fighters, officials, staff, or attendees;
- disrupt the event;
- damage property;
- enter restricted areas;
- obstruct cameras or production equipment;
- interfere with broadcast operations;
- record or redistribute content unlawfully;
- use the event for unauthorized commercial activity.
A venue or event organizer may refuse entry or remove a person for legitimate safety, security, legal, or operational reasons.
Where removal results from your misconduct, you may not be entitled to a refund, subject to applicable law.
20. Event Photography and Recording
HomeCrowd events may be photographed, filmed, livestreamed, or recorded.
By entering a clearly designated recorded event area, you acknowledge that incidental audience images or sounds may appear in:
- live broadcasts;
- replays;
- highlights;
- crowd shots;
- event coverage;
- event archives;
- lawful promotional materials.
This provision does not remove any rights available under applicable privacy or data-protection law.
You may not use professional recording, broadcasting, streaming, or photography equipment without authorization.
Personal, non-commercial photography may be subject to venue or event rules.
21. Livestream Purchases
A livestream pass provides a limited, personal, revocable, non-exclusive, non-transferable right to access the specified stream during the approved access period.
A livestream purchase does not transfer ownership of:
- the broadcast;
- event footage;
- audio;
- graphics;
- commentary;
- statistics;
- highlights;
- recordings;
- intellectual-property rights.
You may use livestream access only for personal, private, non-commercial viewing unless HomeCrowd gives written permission otherwise.
22. Livestream Access Requirements
To access a livestream, you may need:
- a valid HomeCrowd account;
- confirmed payment;
- an active entitlement;
- a supported device;
- a supported browser or application;
- a stable internet connection;
- sufficient data;
- enabled cookies or necessary technologies;
- updated software.
You are responsible for:
- your device;
- your network;
- your data plan;
- your electricity;
- your browser or operating system;
- third-party charges.
HomeCrowd is not responsible for a viewing failure caused solely by your unsupported device, inadequate connection, exhausted data, local power failure, or other circumstance outside HomeCrowd’s reasonable control.
This does not affect any remedy available where HomeCrowd’s service itself was not supplied as required.
23. Stream Timing and Delays
Boxing events may begin later than advertised due to:
- previous bouts;
- medical checks;
- regulatory decisions;
- fighter availability;
- venue operations;
- broadcast requirements;
- safety incidents;
- circumstances outside reasonable control.
Displayed start times may refer to:
- broadcast start;
- undercard start;
- main-card start;
- estimated main-event time.
HomeCrowd will try to describe the relevant time clearly.
A delay does not automatically mean the event is cancelled.
If the event is materially delayed, HomeCrowd may:
- update the event page;
- send a notification;
- extend access;
- provide replay access;
- provide another appropriate remedy.
24. Replay Access
Replay availability depends on:
- rights;
- event agreements;
- territorial restrictions;
- technical availability;
- content review;
- access conditions.
A livestream purchase includes replay only where the event page or checkout expressly states that replay is included.
Replay access may:
- begin after processing;
- have an expiry date;
- differ by location;
- exclude certain segments;
- be withdrawn where required by law or rights restrictions.
HomeCrowd does not guarantee permanent access to a replay unless expressly stated.
25. Device and Concurrency Limits
HomeCrowd may limit:
- simultaneous streams;
- active devices;
- login attempts;
- playback sessions;
- geographic access;
- session duration.
These limits help prevent:
- unauthorized sharing;
- stream piracy;
- fraud;
- platform overload;
- rights violations.
Reasonable device switching may be permitted.
HomeCrowd may require you to:
- close another session;
- verify your identity;
- sign in again;
- contact support.
You must not use technology to bypass device, location, entitlement, or concurrency controls.
26. Prohibited Recording and Redistribution
You must not:
- record an entire livestream;
- restream the broadcast;
- screen-capture the broadcast for redistribution;
- rebroadcast the event publicly;
- transmit the event through social media;
- show the broadcast in a commercial venue without a licence;
- sell access to the stream;
- share protected playback links;
- remove watermarks;
- bypass digital-rights controls;
- reproduce commentary or graphics commercially;
- create unauthorized derivative broadcasts.
Limited personal use may be permitted only where allowed by applicable law and event-specific conditions.
Unauthorized redistribution may result in:
- access termination;
- account suspension;
- ticket cancellation;
- legal action;
- preservation and disclosure of relevant evidence where lawful;
- claims for losses or enforcement costs where permitted.
27. Technical Problems and Livestream Remedies
Internet video can be affected by technical problems.
If a livestream problem occurs, you should:
- check the event status;
- refresh or restart the player;
- confirm your connection;
- try a supported browser or device;
- reduce video quality where available;
- contact HomeCrowd support.
Where a material HomeCrowd-controlled failure prevents a substantial portion of eligible purchasers from accessing the event, HomeCrowd may provide one or more of the following:
- restored live access;
- extended access;
- replay access;
- replacement access;
- account credit;
- partial refund;
- full refund;
- another appropriate remedy required by law.
The appropriate remedy may consider:
- duration of the interruption;
- portion of the event affected;
- whether replay was provided;
- number of users affected;
- cause of the failure;
- legal requirements.
A refund is not automatically available for a problem limited to your device, network, data plan, or other circumstance outside HomeCrowd’s reasonable control.
28. Event Cancellation
If an event is cancelled and will not be rescheduled, affected purchasers will receive a remedy consistent with:
- applicable law;
- event-specific terms;
- product type;
- amounts actually paid;
- benefits already delivered.
For an unused physical ticket or an undelivered event-specific livestream, the normal remedy will be a refund of the eligible amount paid, unless a lawful alternative is accepted by the customer.
The refund may exclude a separately disclosed charge that has been fully earned and is lawfully non-refundable, but only where permitted by law.
HomeCrowd will communicate:
- cancellation status;
- refund process;
- expected timeline;
- support contact.
29. Event Postponement or Rescheduling
If an event is postponed or rescheduled:
- the original ticket or livestream entitlement may remain valid;
- the new date will be communicated;
- access periods may be adjusted;
- additional options may be provided.
A specific refund-request window has not yet been confirmed. Any applicable window will be communicated in the rescheduling notice, subject to applicable law.
Failure to request a refund within the announced period may result in the product remaining valid for the rescheduled event, subject to applicable law.
A short delay or same-day scheduling adjustment is not necessarily a postponement.
30. Fight-Card Changes
Fight cards may change because of:
- injury;
- illness;
- licensing;
- suspension;
- withdrawal;
- travel difficulty;
- weight issues;
- regulatory decisions;
- opponent replacement;
- force majeure;
- other sporting reasons.
Unless event-specific terms state otherwise, a change to:
- an undercard fighter;
- bout order;
- scheduled rounds;
- opponent;
- commentary;
- event presentation
does not automatically entitle a purchaser to a refund if the event still proceeds.
Where a main event or another commercially central part of the event changes materially, HomeCrowd and the promoter will determine an appropriate response consistent with:
- applicable law;
- the event’s marketing;
- the timing of the change;
- event-specific terms;
- consumer expectations.
No provision limits a consumer remedy that must be provided by law.
31. Refund Requests
Refund eligibility depends on:
- product;
- event;
- reason;
- usage;
- event status;
- applicable law;
- event-specific terms.
When refund-request services become available, use the verified support channel identified in section 54 and provide:
- account details;
- order reference;
- product;
- reason;
- supporting information where necessary.
HomeCrowd may verify:
- transaction status;
- ticket usage;
- ticket transfer;
- check-in history;
- stream access;
- playback activity;
- duplicate payments;
- event status.
Approved refunds will ordinarily be returned through the original payment method where possible.
Processing time may depend on:
- payment provider;
- bank;
- payment method;
- settlement status;
- required investigation.
HomeCrowd will not require a consumer to waive a statutory right as a condition of receiving a legally required refund.
32. Chargebacks and Payment Disputes
Before initiating a chargeback, you should contact HomeCrowd so that we can investigate the issue.
You must not initiate a chargeback:
- dishonestly;
- after receiving the purchased service without a valid dispute;
- to avoid these Terms;
- while knowingly retaining a refund or replacement benefit.
HomeCrowd may provide transaction, ticket, attendance, entitlement, and viewing evidence to the payment provider when responding to a dispute.
Where a chargeback is valid, nothing in these Terms prevents the appropriate remedy.
Fraudulent or abusive chargebacks may lead to account restriction or legal action.
33. Promotions, Discounts, and Promotional Codes
Promotions may be subject to:
- eligibility rules;
- start and end dates;
- quantity limits;
- product restrictions;
- one-use limits;
- account restrictions;
- event restrictions;
- separate terms.
Promotional codes:
- have no cash value unless stated;
- may not be sold;
- may not be duplicated;
- may be withdrawn where fraud or error occurs;
- cannot normally be applied after purchase;
- may not be combined unless expressly permitted.
HomeCrowd may cancel a promotion or entry affected by fraud, manipulation, technical error, or legal restriction.
Where required, sales promotions will be registered or approved by the relevant authority.
34. Subscriptions and Recurring Services
If HomeCrowd introduces subscriptions or memberships, the purchase page will explain:
- price;
- billing period;
- included benefits;
- renewal terms;
- cancellation process;
- trial conditions;
- refund conditions.
Where automatic renewal applies:
- it will be disclosed before purchase;
- you authorize recurring charges;
- you may cancel future renewal through the provided method;
- cancellation does not automatically refund a completed billing period unless required by law or stated otherwise.
Material subscription changes will be communicated as required.
35. Merchandise and Physical Goods
If HomeCrowd introduces merchandise, additional terms may address:
- product description;
- size;
- delivery;
- shipping;
- risk of loss;
- returns;
- exchanges;
- damaged goods;

- seller identity.
HomeCrowd may operate as seller, marketplace, or agent depending on the product.

- polls;
- predictions;
- trivia;
- leaderboards;

- reactions;
- comments;
- competitions.
Unless expressly stated and lawfully authorized:
- these features do not involve real-money betting;
- points have no cash value;
- predictions are for entertainment;
- participation does not guarantee a prize;
- virtual items are not withdrawable money.
Separate rules may apply to a competition or prize promotion.
HomeCrowd may remove entries affected by:
- bots;
- multiple accounts;
- manipulation;
- collusion;
- fraudulent activity;
- rule violations.

- a statement that the complaint is made in good faith.
HomeCrowd may:
- request more information;
- restrict or remove content;
- notify the content provider;
- restore content where appropriate;
- preserve relevant evidence;
- take other lawful action.
Knowingly submitting a false rights complaint may create legal liability.
42. Third-Party Services
HomeCrowd may integrate with or link to:
- payment providers;
- streaming providers;
- social networks;
- promoter websites;
- venue services;
- map providers;
- communication providers;
- merchandise sellers;
- identity-verification providers;
- betting partners.
Third-party services may have separate terms and policies.
HomeCrowd is not responsible for an independently operated service merely because it is linked or integrated.
Where HomeCrowd selects or embeds a provider as part of its own service, HomeCrowd remains responsible to the extent required by applicable law.
43. Advertising and Sponsorship
HomeCrowd may display:
- sponsor logos;
- advertising;
- branded content;
- sponsored interviews;
- sponsored statistics;
- sponsored notifications;
- affiliate links.
Sponsored or commercial content may be identified where required.
A sponsor’s appearance does not mean that HomeCrowd:
- guarantees the sponsor’s products;
- accepts responsibility for the sponsor’s independent conduct;
- provides financial or professional advice;
- requires you to purchase the sponsor’s product.
Interactions with an advertiser may be subject to separate terms.
44. Future Betting Services
HomeCrowd’s general ticketing and livestream platform is not automatically a betting service.
Any future real-money betting functionality will require:
- a lawful regulatory structure;
- relevant licences or licensed partners;
- age verification;
- identity verification;
- location verification where required;
- responsible-gaming controls;
- separate betting rules;
- separate financial controls;
- market-settlement rules;
- integrity monitoring;
- additional privacy disclosures.
Unless a separately authorized betting product is expressly launched:
- HomeCrowd does not accept wagers;
- fan predictions have no cash value;
- engagement points cannot be withdrawn as money;
- general account balances are not wagering balances.
HomeCrowd may link to an independently licensed betting operator. The operator’s terms, licensing, privacy policy, responsible-gaming rules, and decisions will apply to that service.
45. Service Availability
HomeCrowd aims to provide a reliable service but does not promise uninterrupted availability at all times.
The platform may be unavailable because of:
- maintenance;
- deployment;
- technical failure;
- provider failure;
- network disruption;
- power failure;
- security incident;
- legal restriction;
- event cancellation;
- force majeure.
Where reasonably possible, we will:
- monitor critical services;
- provide status information;
- restore access;
- communicate material incidents;
- provide appropriate remedies where required.
HomeCrowd may modify or discontinue a non-purchased feature.
A paid service will be handled according to its specific terms and applicable consumer law.
46. Platform Changes
HomeCrowd may improve, update, replace, restrict, or remove platform features.
We may make changes to:
- navigation;
- design;
- supported devices;
- authentication;
- content;
- free features;
- business tools;
- security controls;
- integrations.
We will not knowingly remove a material paid entitlement without providing an appropriate remedy required by the agreement or applicable law.
47. Suspension and Termination
HomeCrowd may restrict, suspend, or terminate access where reasonably necessary because:
- you materially violate these Terms;
- fraud is suspected;
- payment is reversed;
- a ticket is duplicated;
- a stream is redistributed;
- account security is compromised;
- law requires restriction;
- a partner right expires;
- your activity threatens users or systems;
- you repeatedly misuse support, refund, or dispute processes.
Where appropriate, HomeCrowd may:
- warn you;
- request verification;
- temporarily restrict a feature;
- revoke a fraudulent ticket;
- revoke an improperly obtained entitlement;
- remove content;
- terminate an account;
- report unlawful activity.
Where reasonable and lawful, we will provide notice and an opportunity to challenge the restriction.
Immediate restriction may occur where necessary to prevent fraud, harm, security compromise, or unlawful activity.
48. Closing Your Account
You may request account closure through:
- account settings, where available;
- customer support;
- the privacy contact listed in the Privacy Policy.
Closing an account does not automatically:
- cancel a completed purchase;
- create a refund right;
- delete records HomeCrowd must retain;
- remove legitimate public sporting records;
- end an unresolved payment dispute;
- affect rights or obligations that arose before closure.
Information will be handled according to the HomeCrowd Privacy Policy and applicable law.
49. User Responsibility
You are responsible for:
- reading the event page;
- selecting the correct product;
- reviewing the order total;
- providing accurate information;
- maintaining account security;
- checking event updates;
- arriving on time;
- following venue rules;
- using supported technology;
- contacting support promptly;
- not sharing protected access.
You should keep:
- your order reference;
- payment confirmation;
- ticket;
- relevant support correspondence.
50. Disclaimers
To the fullest extent permitted by law:
- event outcomes are uncertain;
- fighter participation may change;
- sporting records may be corrected;
- rankings and opinions may differ;
- estimated times are not guarantees;
- third-party services may experience failures;
- free content may be changed or removed;
- HomeCrowd does not guarantee that every feature will always be available.
HomeCrowd does not provide:
- medical advice;
- legal advice;
- financial advice;
- gambling advice;
- guaranteed sporting predictions;
- guaranteed investment returns;
- guarantees regarding fight outcomes.
Nothing in this section excludes a warranty, duty, or consumer right that cannot lawfully be excluded.
51. Limitation of Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
This includes any liability that cannot lawfully be excluded for:
- fraud;
- fraudulent misrepresentation;
- death or personal injury caused by legally actionable negligence;
- breach of mandatory consumer rights;
- other non-excludable liability.
Subject to the above, HomeCrowd will not be liable for indirect, incidental, special, punitive, or consequential loss where such exclusion is permitted by law, including loss of:
- opportunity;
- anticipated profit;
- reputation;
- business;
- data;
- enjoyment
that was not reasonably foreseeable when the agreement was made.
Where HomeCrowd’s liability may lawfully be limited, its aggregate liability relating to a paid consumer transaction will not exceed the amount paid for the affected product, except where a greater remedy is required by law.
This limitation does not apply to responsibilities that HomeCrowd cannot lawfully restrict.
HomeCrowd is not liable for harm caused solely by:
- your device;
- your internet provider;
- your payment provider;
- your breach of these Terms;
- unauthorized account sharing;
- an independently operated third party;
- inaccurate information you supplied;
- events beyond reasonable control.
52. Indemnity for Business and Misuse Claims
If you use HomeCrowd for business purposes or materially misuse the platform, you agree, to the extent permitted by law, to compensate HomeCrowd for reasonable losses, claims, liabilities, and costs arising directly from:
- your unlawful conduct;
- your infringement of another person’s rights;
- unauthorized content you submit;
- ticket fraud;
- stream piracy;
- misuse of customer information;
- unauthorized representations made on HomeCrowd’s behalf;
- your breach of an applicable business obligation.
This section does not require a consumer to compensate HomeCrowd for HomeCrowd’s own breach, negligence, or unlawful conduct.
53. Force Majeure
HomeCrowd will not be responsible for a delay or failure caused by circumstances beyond its reasonable control, except to the extent applicable law requires a remedy.
Such circumstances may include:
- severe weather;
- flood;
- fire;
- epidemic;
- public-health emergency;
- war;
- terrorism;
- civil disorder;
- government action;
- regulatory prohibition;
- venue closure;
- transportation disruption;
- telecommunications outage;
- widespread power failure;
- internet backbone failure;
- labour dispute;
- natural disaster;
- fighter incapacity;
- other comparable event.
HomeCrowd and the event promoter will take reasonable steps to reduce disruption and communicate material changes.
A force-majeure event does not automatically remove any mandatory refund or consumer obligation.
54. Complaints and Customer Support
If you have a complaint, contact HomeCrowd first so that we can investigate.

A complaint-acknowledgement target has not yet been confirmed. It will be published when support services become available; applicable legal response requirements remain unaffected.
Complex matters involving promoters, venues, payment providers, broadcasters, or security investigations may take longer.
55. Consumer Complaints
Nothing in these Terms prevents you from contacting an appropriate consumer-protection authority.
In Nigeria, complaints may be submitted to the Federal Competition and Consumer Protection Commission.

Complaint portal: https://complaints.fccpc.gov.ng/
You may also have the right to use another lawful dispute-resolution or court process.
56. Dispute Resolution
Before commencing formal proceedings, you and HomeCrowd should attempt in good faith to resolve the dispute through written communication.
A written dispute notice should include:
- the nature of the dispute;
- relevant account or order information;
- supporting facts;
- the resolution requested.
A specific period for informal resolution has not yet been confirmed. Nothing in this section delays urgent action, applicable limitation periods or a legally protected right to seek a remedy.
The parties may agree to mediation.
Nothing in this section:
- prevents either party from seeking urgent court relief;
- prevents a consumer from contacting a regulator;
- prevents use of a legally protected complaint process;
- removes a non-waivable consumer right.
57. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria.
Subject to applicable consumer rights and any valid dispute-resolution agreement, the courts of competent jurisdiction in Nigeria will have jurisdiction over disputes arising from or connected with these Terms.
If applicable law gives you the right to bring a claim in another jurisdiction, this clause does not remove that right.
58. Electronic Communications
You agree that HomeCrowd may provide agreements, notices, receipts, confirmations, disclosures, and other communications electronically where permitted.
Communications may be delivered through:
- email;
- SMS;
- push notification;
- your account;
- the platform;
- another agreed electronic method.
You are responsible for keeping your contact details current.
Electronic records and communications may be used as evidence to the extent permitted by law.
59. Changes to These Terms
HomeCrowd may update these Terms to reflect:
- new services;
- legal changes;
- regulatory requirements;
- security changes;
- operational changes;
- business changes;
- clarification of existing provisions.
The updated Terms will display a revised effective date.
Where a change materially affects your rights or an active paid service, HomeCrowd will provide reasonable notice as required.
Changes will not retrospectively remove a completed consumer right.
If you continue using HomeCrowd after updated Terms take effect, the updated Terms will apply to future use, subject to applicable law.
60. Assignment
You may not transfer your rights or obligations under these Terms without HomeCrowd’s written consent, except where applicable law provides otherwise.
HomeCrowd may transfer its rights and obligations as part of:
- a merger;
- acquisition;
- restructuring;
- investment;
- sale of business;
- transfer to an affiliate.
Any transfer will remain subject to applicable law and will not remove your mandatory consumer rights.
61. No Waiver
If HomeCrowd does not immediately enforce a provision, that does not mean the provision has been waived.
A waiver is effective only where clearly given by an authorized person.
62. Severability
If a provision of these Terms is found unlawful, invalid, or unenforceable:
- that provision will be interpreted or limited to the minimum extent necessary;
- the remaining provisions will continue to apply;
- mandatory law will replace the invalid provision where appropriate.
63. Entire Agreement
These Terms and the documents incorporated into them form the agreement governing your use of HomeCrowd.
They replace prior general discussions or representations concerning the same subject, except:
- a signed agreement;
- a specific written commitment incorporated into your purchase;
- a right that cannot be excluded by law.
64. No Partnership or Agency With Users
Using HomeCrowd does not create:
- employment;
- partnership;
- joint venture;
- franchise;
- fiduciary relationship;
- authority to bind HomeCrowd.
Promoters and other business partners may have separate written agreements defining their relationship with HomeCrowd.
65. Interpretation
In these Terms:
- headings are for convenience;
- singular includes plural where appropriate;
- “including” means “including without limitation”;
- references to writing include legally recognized electronic communications;
- references to law include amendments and replacement legislation;
- an event-specific rule applies only to that event;
- a business user includes an organization and its authorized representatives.
If these Terms are translated, the English version will control to the extent permitted by law unless expressly stated otherwise.
